These Terms of Service ("Terms") govern your use of the Mode application and website at themode.app (the "Service"), operated by NishLabs ("we", "us", "our"). By using the Service, you agree to these Terms.
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account. You must be at least 13 years old to use the Service.
Mode is a goal-tracking and accountability app. You can create goals, track progress, compete with friends, and interact with AI-powered rivals. AI rivals are computer-generated characters that simulate competition — they are not real people.
Free plan: Includes 1 completion goal, 1 recurring goal, and 1 AI rival per goal. You can join unlimited goals created by friends.
Mode Pro: Paid subscription that unlocks unlimited goals and up to 3 AI rivals per goal. Pricing is displayed in the app before purchase.
Free trial: New users receive a 14-day free trial of Mode Pro. After the trial, your goals remain visible but are locked until you subscribe or downgrade to free tier limits.
Subscriptions are billed monthly or annually through the Apple App Store, Google Play Store, or RevenueCat (web). Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your app store account settings or the web billing portal.
Refunds are handled by the respective app store according to their refund policies.

AI rivals are generated using artificial intelligence. Their messages, progress, and reactions are computer-generated and fictional. AI rival behavior is designed to be playful, motivating, and PG-rated. We are not responsible for any AI-generated content that you find objectionable.
You retain ownership of any content you create (goal titles, progress notes, display names). By using the Service, you grant us a license to use this content to operate and improve the Service, including sending it to AI providers to generate rival behavior.
We may delete or remove content that violates these Terms.
We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You may delete your account at any time. We may terminate or suspend your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state where NishLabs is incorporated.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
